Claims, Labeling, & Compliance

Protect your brand and your products from expensive regulatory penalties

Course Dates: April 8 & 9, 2021

Clinicians, nurses, herbalists, dietitians, aromatherapists, and anyone else who formulates and retails health products are required to understand the complex maze of FDA/FTC compliance. Yet few actually master the complexities of the many categories of claims and how to package and sell these products legally and successfully as an integrative health professional.

FDA & FTC claims guidelines are complex, but ignoring these guidelines can lead to business-destroying warning letters and regulatory penalties. Fortunately, there are simple and affordable steps every company in the natural products industry can take to protect their business and their brands.

In this live, interactive, 2-day event, you will master the essentials of claims and compliance to protect your marketing efforts from regulatory penalties.

Session 1

The workshop begins with an in-depth overview of the leading regulatory authorities and what they expect of you and your brand. Both the Food & Drug Administration (FDA) and the Federal Trade Commission (FTC) have authority over natural products. The FDA regulates which types of claims natural products can make depending on your product's classification as a cosmetic, dietary supplement, or drug. The FTC regulates the level of substantiation required to substantiate direct or implied claims in your product's marketing.

Session 2

The next session covers the types of claims your product can make. These include structure function claims for herbal or essential products which are ingested, OTC drug claims based on monographs, and prescription drug claims. You will also learn about the unique botanical drugs pathway offered through the FDA and learn how these claims can fit into any R&D budget.

Session 3

Day two is all about substantiation. Every claim made in your product's marketing, whether direct or implied, must be substantiated scientifically.

In this session we will cover substantiation dossiers, common pitfalls made in claims substantiation, and how to create a quick checklist for substantiating your product's claims. You will also learn how to do a self-audit and protect your company from regulatory action.

Session 4

In the final session, you will learn how to put these claims into a marketing campaign. Labeling requirements, disclaimers, and other applicable FDA/FTC regulations will be addressed.

You will also be empowered to create an ongoing substantiation audit to ensure that your claims remain legal and compliant in the years to come.
